Protecting Your Rights Personalized and Knowledgeable Legal Representation

Copyrights provide creative ideas with legal protection

Not every individual or company uses a patent or trademark to protect their logos, their symbols and their ideas. Some individuals or companies create novel works of authorship. These are protected by copyrights. A novel or original work of authorship can be many things, such as literary work, a musical score, an architectural drawing, a picture or graphic, or an audio recording.

These pieces of creative work can be very profitable, and the person who creates these things deserves the credit for it and the ability to profit off of it, if they so choose. But some people pounce on the opportunity to copycat or sell another person's work without their permission.

Having a copyright to protect your work in this regard is critical. With a copyright you can force people to stop selling or profiting off of your work. Cease and desist orders can help when you have a copyright.

There are things that can't be copyrighted, though. The first item on the checklist is whether the work in question was done in a "tangible" form. What this means is that if something isn't noted or recorded, it can't be copyrighted. An impromptu speech can't be copyrighted.

Other items can't be copyrighted just by their very nature. A list of ingredients can't be copyrighted; familiar symbols and designs can't be copyrighted; similarly, titles and short phrases can't be copyrighted.

If you have questions about copyrights, how your work could be copyrighted, or how to protect your copyright from infringement, get in touch with a lawyer as soon as possible.
